INFORMATION POLICY PURSUANT TO ART. 13 OF LEGISLATIVE DECREE No. 196/2003 AND INFORMATION PURSUANT TO ARTICLES 13 AND 14 OF EUROPEAN REGULATION NO. 2016/679 (GDPR) FOR THE PROCESSING OF PERSONAL DATA

PREMISES

Fibre Net S.p.A. wishes to provide you with information regarding the processing of personal and business data you directly provide as a Customer (defined as “Data Subject”) or otherwise acquired by Fiber Net S.p.A. in the course of the current relationship. Most of the data we process is corporate data and does not fall under the protection of the GDPR, but for us confidentiality and data protection are still important and, in this document, we show the ways in which we process all data, both personal and personal as well as business ones.

Type of data processed
Due to the relationship and in its course, Fibre Net S.p.A. will collect and process those data you directly supplied as Customer or otherwise those data acquired by Fibre Net S.p.A. in the course of the current relationship. The data that will be processed are the data called common as a mere example: name, surname, tax code, address, email address and telephone contact, VAT number and data relating to economic and commercial activity (purchase orders, solvency, bank data, accounting and tax data, etc.).
These data are provided directly by you, also through the website, or they can be collected from data processors (for example by agents and representatives for data relating to contracts and purchase orders, or at commercial information companies or registers, lists or public databases for financial solvency data, etc.)

1) Legal basis
The provision and processing of your data as explained above may take place:

  • for the execution of the contract of which the Data Subject is a party and/or for the pre-contractual phases;
  • for the need to comply with those obligations established by law or by a regulation or by EU legislation, including those provided for by tax legislation;
  • for the pursuit of the legitimate interest of the Data Controller;

  • by virtue of your consent for the direct sale of products or services and purposes of marketing, promotion of activities and presentation of Fibre Net initiatives, by sending advertising material and commercial communications by Fibre Net itself.
  • By virtue of the consent expressed by you to another autonomous data controller authorized to provide us with your data: in this case, we will send you a first request email to send you information/advertising material (the so-called “opt – in”) and, only if you explicitly authorize us, will we continue to process your data in the manner already expressed in this Information Policy.

2) Processing purposes
The processing of your personal data will be carried out in order to properly deliver and manage the services requested by you and in particular:

  • to allow us providing the requested information;
  • to ensure the provision of the service for which activation and the activities connected to it are required;
  • for the necessary fulfillment of the obligations provided for by laws, regulations, community legislation and provisions issued by the authorities legitimated by the law or by supervisory and control bodies;
  • for statistical purposes related to business and market analysis carried out in anonymous and aggregate form;
  • for the direct sale of products or services and for purposes of marketing, promotion of activities and presentation of Fibre Net S.p.A. initiatives, by sending advertising material and commercial communications by Fibre Net S.p.A. with automated methods – i.e., email, fax, SMS – (hereinafter referred to as “Additional Fibre Net Purposes”).
    The provision of data relating to name, surname, email address is mandatory, as each of these data is indispensable for the purposes of providing the service or providing the requested information. Therefore, the relevant refusal, even partial, entails the impossibility for Fibre Net S.p.A. to activate and provide the Service requested by you, as well as to receive the information requested by the Data Subject. The provision of data such as the tax code or VAT number required for compliance with legal obligations or regulations or Community legislation, including those provided for by tax legislation, is mandatory and the processing of such data does not require your consent.
    The consent to the processing of personal data for the “Additional Fibre Net Purposes” referred to above is optional and its non-performance does not prevent you from accessing the services or purchasing Fibre Net SpA products: in this case, in accordance with current standards, we will therefore ask you to give us your explicit consent by ticking the box on the registration and/or request information form.

3) Processing modes and storage period
The data provided or otherwise acquired during the relationship will be processed in paper, electronic or digital format and stored in special archives that may be internal to our structure or even in the cloud, but always stored on servers located within the European Union. The processing of information concerning you will be based on principles of correctness, lawfulness, transparency and protection of your privacy and your rights. In any case, the processing will be carried out with the use of appropriate technical and organizational measures to guarantee the security and confidentiality of the data. The personnel within the company who will process your data will be regularly appointed by us and instructed in this regard on the correct procedures for data management. Your data will not be disclosed, with the exception of the name or logo for commercial reference purposes, if not in an anonymous form for statistical purposes and may be disclosed to the subjects dealing with specific processing phases, as Autonomous Data Controllers or Processors, also external, regularly designated by Fibre Net whose names and relevant qualifications are available at the request of the Data Subjects, as well as to subjects to whom the right to access the data is recognized by provisions of law and secondary standards. Furthermore, Fibre Net may disclose personal data to third parties where required by EU or Member State legislation; in the case of legal proceedings; in response to a request from the police that is based on a legitimate basis; to protect the rights, privacy, security or property of Fibre Net and still, to the extent permitted by law, to investigate, prevent or take measures regarding illegal activities, suspected fraud.
Your data will be kept:

  • for a period equal to that deriving from legal obligations and current tax legislation, in the event a contractual relationship is established;
  • until the end of the follow-up operations in the event they have been given exclusively for participation in events organized by Fibre Net;
  • until the revocation for events, services and products promotion activities: in all our newsletters, for example, the possibility to revoke the consent and ask us, therefore, not to be contacted is indicated.

5) Rights of the Data Subject
In your capacity as a Data Subject, you have the rights referred to in Art. 7 of the Privacy Code and Art. 15 of the European Regulation 679/2016 (GDPR); where applicable, you also has the rights referred to in Articles 16-21 of the GDPR (Right of rectification, right to oblivion, right to limitation of processing, right to data portability, right to object), as well as the right to complain to the Guarantor Authority.
